Summary

The Industrial Relations Commission of New South Wales (ii) was established by the Industrial Relations Act, 1996 on 2 September, 1996.

The role of the Industrial Relations Commission was to set remuneration and other conditions of employment, resolve industrial disputes, hear and determine other industrial matters and inquire into and report upon any matter referred to it by the Minister.

The Commission consisted of a President, Vice President, Deputy Presidents and Commissioners. The President, Vice President and Deputy Presidents are referred to as Presidential Members. The members of the Commission are appointed by the Governor.

The Industrial Relations Commission may be constituted by one member or a Full Bench of the Commission. A Full Bench of the Commission consists of at least three members and must include one Presidential Member and one Commissioner.

The "Commission in Court Session" is constituted by a judicial member or members of the Industrial Relations Commission appointed by the governor. The Commission is a superior court of record. Certain functions can only be exercised by a "Commission in Court Session" these include proceedings relating to contempt before the Commission, unfair contracts, contravention of a dispute order and breaches of an industrial instrument.

The Industrial Relations Commission constituted by a Presidential Member, may establish an Industrial Committee, on application, to cover the whole or any part of a particular industry. An Industrial Committee shall consist of a member of the Commission who shall also act as chairperson and equal numbers of representatives of employees and employers.

The members of an Industrial Committee, with the exception of the chairperson, shall be appointed by the Industrial Registrar. The role of the Commission under this act may be exercised by an Industrial Committee with regards to the industry for which it has been established.
